Nursing Home Negligence

Approximately 1.6 million adults and senior citizens in the U.S. live in long-term care facilities, which has lead to a heightened risk of nursing home mistakes, malpractice and even abuse.  The consequences of negligent care or abuse are devastating and may include emotional and physical injury and even death. Unfortunately, negligent care in nursing homes often goes underreported, which further complicates efforts to protect our elderly and infirm.

If you or someone you love has been a victim of nursing home negligence or abuse, you need to understand that you have legal rights and options. Please contact one of the experienced nursing home lawyers at Cline Farrell Christie Lee & Caress to learn more about how you may be eligible to recover your losses. We are happy to offer you a free evaluation of your potential case and advise you as to your legal options.

Types of Nursing Home Negligence and Abuse

Nursing home negligence and/or abuse involves many types of inappropriate care of a patient, including the following:

  • Failure to monitor a patient properly
  • Failure to properly and timely attend to a patient's needs --- eating, drinking, dressing changes, medication, etc.
  • Physical abuse is any from of physical contact—slapping, hitting, kicking, over-or-under-dosing drugs—that causes harm to a patient. Indicators of abuse can include unexplained injuries like bruises, wounds, fractures, internal bleeding, and more.
  • Emotional and verbal abuse includes all verbal and/or non-verbal acts of violence or aggression including insults, threats, humiliation, intimidations, harassment, and more—often resulting in severe psychological distress to a resident.
  • Sexual assault and/or abuse involves acts of non-consensual sex with a resident of a nursing home including rape, sexual assault and battery, forced nudity, and acts of obscenity.
  • Financial exploitation of a nursing home resident occurs when the facility fraudulently or deceptively exploits the resident’s assets, finances, or property without their consent.
